Abstract

The development of modern generation appearance, which supported by the trend of using imported cosmetics for supporting their perfect performances places cosmetics as a primary need that must be met. This encourages creativity and innovation of business actors both domestic and abroad to provide or produce cosmetics in mass with various types and properties to earn maximum profits. The ease of technology ensures the pattern of production and marketing which prioritizes their own interests by committing fraud, especially in the fulfilment of selling requirements and after-sales services. This condition ultimately raises significant problem especially with the circulation of imported cosmetics without the inclusion of labels using Indonesian which is very detrimental for consumers because they are very dependent on the accuracy or honesty of the information conveyed by business actors through product labels in consideration that it contains representations, warnings, and instructions from the products. This research is a library research by making library material as the main data source. In this study, the data collection techniques uses secondary data in the form of books, journals, papers, articles, and documents related to this research. The kind of this research is descriptive analysis, which aims to describe or give an overview of an object of research about the inclusion of information on imported cosmetic product labels using Indonesian in the perspective of Islamic law and positive law in Indonesia. The research approach used in this research is a juridical normative approach, which based on Sadd Al-Żarī’ah and the Minister of Home Affairs Regulation Number 73 / M-Dag / Per / 9/2015 concerning the Obligation of Labelling in Indonesian which was correlated with the Consumer Protection Act. The results of the research which based on Sadd Al-Żarī’ah's theory says that in order to eliminate anxiety/gharar and loss which is experienced by consumers and business actors, producers are required to include information on product labels using Indonesian. As the Minister of Home Affairs Regulation Number 73 / MDag / Per / 9/2015 concerning the obligation to include labels in Indonesian and Article 7 letter b UUPK according to Perka BPOM Number 19 Year 2015 concerning cosmetic technical requirements. If business actors violate the provisions by not including information on the product label and selling defective products which finally harms the consumers, it will be subjected to administrative sanctions in the form of revocation marketing licenses and the losses on imported cosmetic products are accounted as the responsibility of the business actors to provide forms of compensation by giving refunds, or product replacement, or health care and or compensation.
