Abstract

The role of the witnessis in every trial of the criminal case is crucial because frequent witness information can affect and determine tendencies judge’s decision. According to the article 1 verse 26, the witness is a person who can provide information for the benefit of the investigation, prosecuations and justice about a criminal case he hears himself, see for himself, and he experiences himself in such a sense it comes to a conclusion that anyone can be a witness and can testify without status of the person mentioned. Including the suspect or the defendant law number 8 in 1981 about KUHAP stated, there were 5 (five) different kind of limitative in order to settle the crime. But in organized crime, like a criminal act, a criminal act requires an alternative solution of the solution namely witness of the collaborating actors (justice collaborator. The research method that complies is a method of field research with the nature of analytical research to decipher. The systematic application of the witness who is imvolved (justice collaborator) in the corruption of the plot of the soil for the construction of the search office. The approach used in this study is the judicial approach by seeing the counsel of the attorney general and the assembly the judge in the case was then adapted to the rules governing it the framework of the theory used by the compiling in this studi is as follows:first, there’s an evidentiary system to know how to put a proven outcome againts the criminal case. Secondly, witness are working together. Third, a special line concept that can be combined with the plea baragaining system. The result of studi concluded that in the case of the procuring of the land by Special Region Of Yogyakarta Search And Rescue Institution with the defendant Waluyo Raharjo Bin Kasimun Wardoyo under counsel is based on public prosecutor’s discretion as a witness of the cooperation (justice collaborator) with the memory of supreme court number 04 in 2011 in order number 9, and chapter 10 verse (2) of the ruling of the judge assembly rules number 13 in 2006 who considers the status of the public prosecutor by dropping lower penalties from the main perpetrator. In spite of the differences of judgement that the judge’s judgement is higher than the prosecutor’s demand, but it does not the defendant’s status as a witness of the murdered (justice collaborator) is because in KUHAP there is not a single chapter that requires a judge to cut off the indictment according to the general prosecutor’s office. The judge has the freedom to determine the position and consideratio the law and his conscience.
