Abstract

A cooperation agreements is an agreement where two people or more put something in wealth for obtaining profit. Cooperation agreements can be done by one of them by using standart contracts. A standart contracts is an agreement made by one part and the other part can only accept or reject the agreement. As the cooperation between The Industry and Trade Department of the City of Yogyakarta with CV. Damai Sejahtera define that distribution of results are using the percentage of 60% : 40% but also the determination of revenue as a target of income every month and withdrawal of fees does not use a retribution ticket and violates regional regulation number 5 of 2012 about concerning public service fees. This research aims to determine how the application of standart contracts in cooperation agreements between The Industry and Trade Department of the City of Yogyakarta with CV. Damai Sejahtera in terms of Islamic law using field research. The focus of this research is by conduct observations in field and also verify collected data by conducting interviews and documentations in Demangan market. Furthermore, the approach chosen in this study is normative by seeing whether the cooperation agreements is in accordance with the principles of Islamic law and analyzed using theory of the agreement in Islamic law. Based on the results of the study, the implementation of cooperation agreements in bathroom management is in accordance with Syirkah Inan contract and the fulfillment of the terms. Despite unbalanced performance and contrary to the principles of fairness on target income generation and revenue sharing but do not make this financing contract is canceled because there is element of rida. Then there is an excsoneration clause in unilateral termination of the agreement that the parties have low bargaining power but the cooperation agreement using this standard contract can still be applied to the origin is not contrary to Islamic law and unilateral termination can be done by giving the organizer the opportunity to conduct consultation.
