Abstract

Law enforcement for the protection of a copyright work is regulated by Act Number 28 in 2014 that concerns about Copyright. The problem of the research is a community especially among students that know about the practice of copying books is violation of copyright but until now they still do copy the books. Whereas the protection rule of a copyrighted work is clear through the Act of Copyright. In addition, Islam views Copyright as one of the huquq maliyyah (property rights) that has legal protection (mashu) as a mal (wealth) which basically respects intellectual property rights as a result of human creativity needing to be protected by ownership. This research is a field research with a normative approach to legal sociology, which includes any factors causing the rampant practice of copying books that are still exist. While the data analysis method uses descriptive analytic. In the data collection method, the author uses the observation method, interviews, and distributes questionnaires. The feature of this research is descriptive analytic. In this research, the author uses the theory of legal awareness and legal compliance. Furthermore, regarding legal control related to the problem, the author uses the theory of law enforcement. The result of this research shows that there are several factors causing the many practices of copying books since community knowledge of law about Act Number 28 in 2014, copyright, is still low. Photocopy business actors who do not comply with and obey the regulations that have been made by the government and lack of government supervision. The practice of copying book is a complaint offense, which is if the aggrieved or the writer of the book does not report the problem, so law enforcement officials will not follow up on it. In addition, the weak law enforcement and the awareness of the society about law also greatly affected the parties to do copy books. When a rule is not profitable or is not affiliated with the socio-economic community, accordingly the violation practice exists. Even though Islamic law has also been regulated in this regard.
