Abstract

Humans are social creatures who need to help other humans to meet their needs. One that can be done for meeting the needs is the existence of buying and selling activities in the community. From time to the time of buying and selling activities have changed, one of them in terms of payment and transaction system. Among the trading activities that are experienced changes in the transaction system, one of which is the sale and purchase of BRANKAS gold. BRANKAS is an abbreviation of Safe Plan to Manage Gold which is managed by the Gold Boutique ANTAM Yogyakarta. Every BRANKAS consumer has a BRANKAS account used to conduct gold transactions. The price of BRANKAS gold is different from the price of other gold bars, it is influenced by the cost of other fees such as the BRANKAS membership fee, gold printing fees, and shipping costs gold. This research is library research. Library research where the problem is based on data and documents taken from the website as well BRANKAS accounts belong to consumers as primary data, while secondary data are fiqh books and other books relating to buying and selling rent in Islam. The nature of this research is descriptive analysis with describe the practice of buying and selling gold in BRANKAS then analyzing the practice uses a review of Islamic law. The results of this study, the practice of buying and selling gold transactions of BRANKAS BRANKAS is one form of multi-contract or al-‘uqud al murakkabah where there are two contracts, namely akad bai ‟(buy and sell) with ijarah or rent. This transaction enters the category of multi-contract al-'uqûd al-mutaqâbilah, i.e. contract dependent/contract conditional. Where there is a gold purchase contract depends on the existence of a lease BRANKAS membership. The existence of the contract is in the sale and purchase of gold transactions BRANKAS causes a tendency to fall into usury so that it exists this transaction is deemed to deviate from the limits of al-‘uqud al murakkabah.
