Abstract

Custom bike industry has become more popular, especially in Yogyakarta. Ever since many custom bike festivals such as Kustomfest are held and the emerging trend of state officials who showed interest in custom bike, many people are following the trend and creating demand of the custom bike workshop existence. Meanwhile, the increasing numbers of custom bike workshop is not accompanied by legal protection on the work produced. This research aims to understand the law about intellectual property rights and the implementation of law number 31 year 2000 about industrial design towards custom bike business in Yogyakarta. This research uses normative-empirical qualitative method with library study and interview serving as the data collection techqnique. The anlaysis units in this research are three custom bike workshops in Yogyakarta: Haps – Hapsautowork, Agus Setyanto – Forever and Yoga – Dulur Motor. The result of this research shows that the law about intellectual property rights that can be implemented on custom bike business is only the law number 31 year 2000 about industrial design, and that the implementation of the law is yet not optimum in Yogyakarta because of the lack of knowledge of the owner of the businesses regarding the existence of the lawsuit through law number 31 year 2000 about industrial design. Based on the result, the government is expected to be able to provide better support to the custom bike industry by issuing a clear law that govern the industry and also providing socialization and information about the lawsuit that can be submitted towards the produced work.
