Abstract

The article tries to rethink the implementation of rajam law for zina conductor who has a wife or husband (muhsân), through describing the historicity of Hadis on rajam taken by fuqaha as source of law. In fact, at a moment Prophet Muhammad SAW had ever applied rajam law, but at other moment he did not apply it. It does not mean that he was not consistent, but because of the situation and condition of conductor he considered before deciding and judging the law. Through reading and scrutinizing the historical context of rajam hadis can be disclosed that even though hadis on rajam categorized hadis sahih, but in its application it is hadis ghair ma’mul bih because it had been erased by Al- Qur’an Surah An-Nur (24) verse two.
