Abstract
"Social justice for all the people of Indonesia", so the sound of the fifth sila in the base of our country, Indonesia, by implementing Ordinance No. MPR I/MPR/2003 which invites all Indonesian to develop noble deeds, reflect a family atmosphere and mutual cooperation as a proof of the spirit of nationality based on Pancasila. Government of Indonesia ratified the Ordinance No. 23- year 2011 about management of the Charity which it’s main purpose is to solve any grain of gaps that occur in the community. Islam also teach such things, however in that ordinance is not described about terms of distributing alms clearly. It only mentioned with the clause "in accordance with the Islamic Sharia". The researcher feel important to make a research about the condition when alms assign to the other areas (region) whereas in the same region there are still found so many mustahik using Islamic law and views of Wahbah az-Zuhaili in the distribution of alms. By this issue, the author try to research and examine how the regional boundaries of distribution of alms.. This research is a kind of library research, a descriptive analytical research focused on the area of distribution of alms. In this research, the researcher use an approach to Islamic law using the Istinbat law methods. It means that researcher set out from the background of the problem and then review by studying the law operates to the opinion Wahbah az-Zuha ili about the distribution of alms and make a comparation with juridical foundation about the territorial boundaries of distributing alms with management of Alms Law Number 23 of the year 2011. After that, we can see how is the relevance that occur in Indonesia. This research is using deductive and inductive methods. Inductive method is used to analyze data obtained from what is contained in the literature review (nass) that is ready to use (ready made) to uncover and conclude the problem, circumstances, events or objects that are observed, namely in the form of limits area distribution of alms in Indonesia. so it collect an understanding of \ how Islamic law provisions regarding territorial boundaries of distribution if alms. While deductive method is used to analyze the relevance of the practice of distributing alms in Indonesia. Based on the identification (research), the territorial boundaries of distributing alms based on Wahbah az-Zuhaili’s opinion with Istinbat law, both from the Qur'an and Hadith, or opinion of the priests, it conclude that the distribution of alms has territorial boundaries. It is equal to the distance of a traveler that should make his prayers take in one time (jama)’. Whereas, the other conclusions, in linguistic, ‘bilad’ could mean as an area (if in Indonesia it called provinces). The result shows that relevance between distribution of alms and some opinions above in Indonesia is in compliance condition. It means that alms which is already evenly distributed can exit the area by using the normative study of Article 690 KHESY as well as Ordinance No. 23 of the year 2011.
