Abstract

Indonesia is an agrarian country that is a nation where most of its people live from farming, or the lives of its people relying on the agricultural sector. Covered by agricultural sector in various commodities has a large contribution to the national economy. The Health Law Number 36 of 2009 concerning the provision of facilities for smoking special areas instead has caused a little controversy. Where in this case, tobacco is included into group of addictive substances in article 113 and the application of seven areas without cigarettes (KTR) in article 115 paragraph (1) which is a more detailed about addition of government regulations Number 81 of 1999, as well as the obligation for regional governments to implement non-smoking area (KTR) in its region. The places or areas that are prohibited from smoking include health care facilities, places for teaching and learning, children's playgrounds, places of worship and public transportation. As stated in government regulation Number 81 of 1999, in this law adds two other categories of nonsmoking area, namely workplaces and public places other places that have been set. Along with the regional regulations on non-smoking areas (KTR) that were made, it should have been about providing facilities specifically for smoking, it should also be run. But this is not what happen in the real. There are still a number of managers or leaders of an area that do not provide special facilities This type of research is literature (library research), namely research by studying and analyzing written sources related to the object of discussion so that clear data can be obtained, in order to assist in this study. Compiling theoretical framework is the Maqasid asy- Syariah theory . The results of this study indicate that asy- Maqasid perspective shari'a on the provision of special facilities where smoking is already regarded as the ideal goal. But can not say a whole, because they have yet to translate about a place and be l um creation of rights that should be obtained both for active smokers. The existence of rules regarding the provision of facilities specifically for smoking is a minimizing risk (taqlil al- mafsadah). The purpose of which is that active smokers do not carry out smoking activities the place where are not permitted for smoking[INDONESIA]Indonesia merupakan negara agraris yakni suatu bangsa yang sebagian besar masyarakatnya hidup dari bercocok tanam (bertani) atau kehidupan masyarakatnya bertumpu pada sektor pertanian. Dilingkup sektor pertanian dalam berbagai komoditasnya mempunyai kontribusi besar terhadap perekonomian nasional. Undang-undang Kesehatan Nomor 36 Tahun 2009 tentang penyediaan fasilitas tempat khusus untuk merokok ini sedikit menimbulkan kontroversi. Dimana dalam hal ini, tembakau dimasukkan kedalam golongan zat adiktif dalam Pasal 113 dan penerapan tujuh kawasan tanpa rokok (KTR) dalam Pasal 115 ayat (1) yang merupakan penambahan lebih rinci dari aturan pemerintah Nomor 81 Tahun 1999, serta kewajiban bagi pemerintah daerah untuk menerapkan kawasan tanpa rokok (KTR) di wilayahnya. Adapun tempat atau kawasan yang dilarang untuk merokok diantaranya yakni fasilitas pelayanan kesehatan, tempat proses belajar mengajar, tempat bermain anak, tempat ibadah dan angkutan umum. Sebagaimana telah tercantum dalam peraturan pemerintah Nomor 81 Tahun 1999, dalam undang-undang ini menambahkan dua kategori kawasan lain, yakni tempat kerja dan tempat umum dan tempat lain yang sudah ditetapkan. Beriringan dengan peraturan daerah tentang kawasan tanpa rokok (KTR) yang dibuat, seharusnya tentang penyediaan fasilitas tempat khusus untuk merokok ini sudah sepatutnya berjalan juga. Namun tidak demikian di lapangan. Masih banyak beberapa pengelola atau penanggungjawab suatu kawasan yang tidak memberikan penyediaan fasilitas tempat khusus Jenis penelitian ini adalah kepustakaan (library research) yaitu penelitian dengan cara mengkaji dan menelaah sumber-sumber tertulis yang terkait dengan obyek pembahasan agar dapat diperoleh data-data yang jelas sehingga akan membantu dalam kajian ini. Kerangka teori yang penyusun pakai adalah teori Maqasid asy- Syariah. Hasil penelitian ini menunjukkan bahwa perspektif Maqasid asy- Syariah terhadap penyediaan fasilitas tempat khusus merokok sudah dianggap sebagai cita yang ideal. Tetapi belum bisa dikatakan menyeluruh, karena masih belum terealisasikan perihal tempat dan belum terciptanya hak-hak yang harusnya didapatkan oleh perokok aktif khususnya. Adanya aturan tentang penyediaan fasilitas tempat khusus untuk merokok ini merupakan suatu upaya meminimalisir risiko (taqlil al- mafsadah) yang mana tujuannya adalah agar para perokok aktif tidak melakukan kegiatan merokok tidak disembarang tempat.
