Abstract

The process of buying and selling transactions carried out in traditional markets is basically limited to transactions between the final consumer and the consumer between, but it is different from what happened in Setan Maguwoharjo Traditional Market where buying and selling transactions are not only limited to the final consumer and between consumers but between suppliers and consumers. between (retailers). By using Law Number 8 of 1999 concerning Consumer Protection, there are rights and obligations that must be fulfilled between consumers (retailers) and business actors (suppliers), with issues that make consumers and business actors unable to fulfill their rights and obligations (default). The formulation of the problem of this research is, are the buying and selling transactions between suppliers and retailers at Setan Maguwoharjo Traditional Market in accordance with positive legal rules in Indonesia? And how is the settlement of default between suppliers and retailers at Setan Maguwoharjo Traditional Market in terms of positive law in Indonesia? To answer the problem formulation above, the research method used is a type of field research (field research). The research object is studied by looking at events directly in the field, government regulations, legislation and files related to the object of research. The nature of this research is descriptive-analytic, namely by describing information and descriptions of the research subject and reviewing it with positive legal regulations and analyzing it using a theoretical framework and related materials. The research approach uses a juridical approach, which is related to Law Number 8 of 1999 and the Civil Code of Book 3 on Engagement. The theoretical framework used in this research is the theory of legal certainty, the theory of agreement, and the theory of condumen protection and business actors. The results of this study indicate that first, the process of buying and selling transactions between suppliers and retailers in Pasar Setan Maguwoharjo is in accordance with the positive laws in Indonesia, because the buying and selling activities are unconsciously carried out based on Code Of Civil Law Article 1458 Book 3 where the goods are that has been received is the responsibility of the buyer even though the goods are not in the buyer's hands because an agreement has been made. Second, the default that occurs is because the retailer is unable to pay the price of the goods purchased and an agreement has been made between the two parties and causes losses to the supplier. The solutions that can be used to reduce losses are; a. contain notes kasbon notes, b. personal purchase record book, c. restrictions on purchases by suppliers to certain retailers with unfavorable records, and d. apply minimum payment standards in every purchase.
