Abstract

Food is one of the human necessity that must be fulfiled. According to Law No.18 of 2012 about Food mention that food is everything that comes from the biological source of agricultural products, plantations, forestry, fisheries, farms, waters, and water, whether processed or unprocessed that is intended as food or beverages for human consumption, including food additives, food raw materials, and other materials used in the process of preparing, processing, and/or making food or beverage. Food product can be found in markets until department stores. In product circulation, the one that need to be noticed is an expired product because it can be harmful for human health. That matter is for protect the consumer. Expired food prevention is an obligation of businessman according to Law No. 8 of 1999 about consumers protection especially „Murah‟ Minimarket as observation object. The goal of this observation is for explain „Murah‟ Minimarket to prevent expired food and drink circulation and acknowledge responsibility of „Murah‟ Minimarket depend consumers complain. This type of research is field research with a juridical-empirical approach. The nature of this study is descriptive anlitis. Data collection techniques in this writing are obtained by means of interviews and literature studies. Data analysis uses qualitative analysis methods and draws deductive conclusions. The results showed that: First, prevention of the circulation of expired food and beverages in Minimarket Murah is done by conducting supervision by various parties ranging from admins, employees, to shop owners. It is in accordance with Law No. 8 of 1999 concerning Consumer Protection, especially in the obligations of businesses contained in Article 7 letter d, namely Guaranteeing the quality of goods and/or services produced and/or traded based on the provisions of the applicable quality standards of goods and/or services. Second, Minimarket Murah has full responsibility for the products distributed. In terms of handling consumer complaints, the store has its own procedures. In the event of compensation, the store may provide compensation in the form of similar goods or money. The responsibility carried out by Minimarket Murah is in accordance with the provisions contained in article 19 of Law No. 8 of 1999 concerning Consumer Protection.
