Abstract
At the end of 2017, 78 out of 132 (60%) DPD members were affiliated with political parties, some of whom were active administrators of political parties at the central level. Thus at the end of 2022, there were 19 active DPD members who had been affiliated with political parties. Meaning, a total of 13.9% of DPD members are still affiliated with political parties. In 2018, Muhammad Hafidz applied for a judicial review, which led to the Constitutional Court issuing Court Judgment No. 30/PUU-XVI/2018. The efforts to purify the DPD from elements of political parties is going better, however, that does not mean that the current DPD is totally excluded from political parties, there are currently many DPD members who are affiliated with political parties, despite the Constitutional Court's decision No. 30/PUU-XVI/2018 only mentions functionaries /administrators of political parties, but members who carry political party ideology can also damage the image of the aspirations of the Regional Representatives Council itself, especially not everyone apprehend the conditions and culture in each region. This study uses normative legal research methods qualitatively (library research). The main components of this research uses primary legal materials and secondary legal materials in the process with a statute approach and a conceptual approach to obtain an in-depth and comprehensive understanding of the efforts to purify DPD members from political party elements. The analysis will include and combine the concepts of a bicameral parliament and fiqh siyasah as the theoretical basis. The results of the study based on the analysis concluded that the efforts to purify DPD members had been running smoothly after the Constitutional Court's decision Number 30/PUU-XVI/2018, but the practice in the 2019 elections had not been heeded by several parties. More than that, the practices carried out by several parties who opposed and did not carry out the decision also violated the principles of fiqh siyasa.
