Abstract
The establishment of the IKN Authority Agency raises issues because the transfer of the capital of the Republic of Indonesia as the center of government to Penajam Paser Utara Regency, East Kalimantan Province requires a legal umbrella, namely Law Number 3 of 2022 concerning the State Capital of the Republic of Indonesia in an effort to reduce the burden on Java Island, especially the City of Jakarta as the center of Indonesian government and business in the future, resulting in economic equality and development on the island of Kalimantan. It is interesting to study in the perspective of maṣlaḥah mursalah how the establishment of the IKN Authority Agency should be based on 18 Paragraph (3) and (4) of the 1945 Constitution of the Republic of Indonesia. The type of research in this paper is literature with descriptive analysis. The research approach is normative juridical. Research legal materials in the form of primary, secondary and tertiary data. Qualitative analysis techniques based on Mahfud MD's legal politics and Abdul Wahhab Khallaf's maṣlaḥah mursalah in order to answer this research problem. The results show that the establishment of the IKN Authority Agency is contrary to article 18 paragraph (3) and (4) of the 1945 Constitution, which states that each region is led by a head of government (governor) elected through general elections. Meanwhile, the head of the IKN Authority is appointed by the President. From the perspective of Abdul Wahhab Khallaf's maṣlaḥah mursalah, the establishment of the IKN Authority Board has not been in accordance with the existing requirements, namely that the maṣlaḥah made must be general and not the benefit of individuals or certain groups.
