"Fiqh is the nearest part in the religious life of the Islamic society.\r\nAlmost all of the religious practices in the society are besed on the fiqh.\r\nOn the other hand, fiqh is the product of fuqaha’s ijtihad which open\r\nto the change and diversity. The one of causes which became the change\r\nand diversity in fiqh is illat concept. The existing or lacking of law\r\nare dipend on the illat, therefor the illat of law elaboration became\r\nvery impormant. The science and tecnology development can be\r\nrecognized as the illat of law change. The law which had been formed\r\nby the classic and medieval ulama can be canged. It is not effective in\r\nthe science and tecnology development era. The finding of new law\r\nbecome the new law illat. The concepts of majlis, safar, iddah need to be\r\ninterpreted because of theinformation and transportation tecnology\r\ndevelopment. Therefore, it is impoetant to develope the concept of illat\r\nwhich is suitable with the Islamic law formative orientation (maqasid\r\nasy-syari’ah). The illat of law must capable to make law which is\r\nimplied the mashlahah and relevant to the civilization development,\r\nin order to keep the fiqh flexibility and significancy to the life realities.\r\nThe process can be conducted by activizing ijtihad, fusing between the\r\nistinbat (deductive) and istiqra’ (induktif) methods. The ijtihad model\r\ndepends on the real problems, einther by using the tarjih intiqa’i or\r\nibdai insyai models.\r\nAbstrak\r\nFiqh adalah bagian terdekat dalam kehidupan keagamaan umat Islam.\r\nHampir semua praktek keagamaan umat Islam berpedoman pada ketentuan fiqh. Padahal fiqh merupakan hasil ijtihad fuqaha yang\r\nterbuka bagi perubahan dan bahkan juga perbedaan. Salah satu yang\r\nmenjadi penyebab perubahan dan perbedaan dalam ketentuan fiqh\r\nadalah konsep ’illat. Keberadaan ’illat menentukan ada atau tidaknya\r\nsuatu hukum, sehingga elaborasi tentang ’illat hukum menjadi penting\r\nuntuk dilakukan. Perkembangan ilmu dan teknologi dapat menjadi\r\n’illat bagi perubahan hukum. Hukum yang diputuskan para ulama\r\nklasik dan pertengahan dapat berubah atau tidak lagi efektif karena\r\nadanya kemajuan sains dan teknologi. Penemuan baru dapat menjadi\r\n’illat bagi hukum baru. Konsep majlis, safar, dan iddah, misalnya,\r\nperlu direinterpretasi karena kemajuan teknologi informasi dan\r\ntransportasi. Oleh karena itu, perlu pengembangan konsep ’illat yang\r\nselaras dengan tujuan pembentukan hukum atau maqashid asy-syari’ah.\r\n’Illat hukum harus dapat membuat hukum yang ditetapkan membawa\r\nmaslahah dan relevan dengan kemajuan peradaban, untuk menjaga\r\nfleksibilitas dan signifikansi fiqh dengan realitas kehidupan. Proses\r\nini dapat dilakukan dengan mengaktifkan ijtihad, dengan memadukan\r\nantara metode istimbat (deduktif) dan metode istiqra’ (induktif).\r\nModel ijtihadnya tergantung pada persoalan yang dihadapi, apakah\r\nmenggunakan model tarjihi intiqa’i atau ibdai insyai.\r\nKata Kunci: ’illat, sains, ijtihad, maqashid asy-syari’ah."^^ .
