This giveaway practice uses instagram social media because it has various supportive features. Almost all online shop implement this giveaway. The parties involved in this giveaway practice are the organizers of the online shop itself, whereas the participants are the instagram users who are interested in participating with the giveaway. The implementation of giveaway so far no standard provisions. Generally giveaway provide provisions with re-post photos, invite other friends to spam like. The organizers adopted the giveaway from online shop to one another and then adjusted to the online shop criteria. This research is a type of clinical research that aims to find syar'i law which is included in qualitative research based on data from field and library materials. This study is analytical descriptive to obtain facts so as to get the full picture. Data obtained from organizers and giveaway participants. Sampling technique with purposive sampling technique while data collection with direct interview and documentation. The analysis is used by means of inductive thinking. The theory of contracts in Islamic law is the focus of research to analyze giveaway practices. The results can show the mechanism of giveaway practice. Additionally, through the terms and conditions of giveaway practice, it raises a variety of uncertainties from its implementation.
