%T TINJAUAN YURIDIS TERHADAP SISTEM PENGUPAHAN TENAGA KERJA DI YAYASAN MASJID SYUHADA
%X Yayasan Masjid Syuhada is classified as a company according to company
definition in Law Number 13 Year 2003. Therefore, the foundation must be subject to
Labor Law and other Regulation of Labor. In the case of remuneration, Yayasan
Masjid Martuh must be subject to Article 90 of Law no. 13 of 2003 concerning
Manpower that prohibits employers or companies from paying wages lower than the
minimum wage set. The formulation of the problem studied is the system of wage
labor in Yayasan Masjid Syuhada, viewed from the juridical view, and the factors that
affect the minimum wage rules can not be applied properly in Yayasan Masjid
Syuhada.
This research is a field study, which is then analyzed using a juridical point of
view. The analysis uses the theory of minimum wage, foundation, and legal
effectiveness theory.
Wage labor at Yayasan Masjid Syuhada uses a monthly wage system or
monthly wage. This monthly wage consists of basic salary, fixed allowances, and
non-permanent benefits. In juridical terms, the wage system in Yayasan Masjid
Syuhada has violated the rules related to the prohibition of employers or companies
paying wages lower than the minimum wage set. Factors that affect the wages system
in Yayasan Masjid Syuhada can not be applied with the UMK Yogyakarta is due to
three factors: the condition of Yayasan Masjid Syuhada which is a social institution,
the financial factor of mosque martyrs that comes from infak Masjid, donation of the
implementation of education from students not yet able to be used in raising
employee's basic salary scale, and employee's occupational type factor at Yayasan
Masjid Syuhada.
