N2  - This dissertation aims to examine the out-of-married-born-children
lineage issue from a critical and comparative perspective in
combination of traditional Islamic jurisprudence, positive law, and the
fatwa of the Indonesian Ulama Council, within the framework of the
Sharia?s higher objectives (Maqasid al-Sharia). The study seeks to
gain social justice and public interest through a lineage concept
reconstruction, in which lawful- and unlawful-children discrimination
can be eliminated, and lineage, wealth, inheritance, and other
fundamental entitlements for equal rights can be ascertained. The
research also focuses on modernizing the lineage establishment
mechanism by adopting DNA testing a primary means of resolving
lineage-related disputes, rather than relying solely on marital ties as
definitive proof. The findings indicate that the use of scientific
methods, such as genetic testing, aligns with the objectives of Sharia
in promoting justice, protecting individual rights, and preventing
from harm and injustice practice. Furthermore, the dissertation
suggests a very foundation review of traditional jurisprudence
interpretations of lineage, and takes scientific and social
developments into account to present a law-taking-process
contribution and a contemporary law reform in accordance with the
holy spirit of Islamic law. The study concludes that reconstructing the
concept of lineage in Maqasid al-Sharia perspective can bring about
a fundamental shift in addressing lineage issues, and achieving social
justice while preserving authentic Islamic values
