%X Thesis entitled “Overview of Islamic law regarding the implementation of fiduciary guarantees in non-Bank financial institutions (case study at shari‟ah pawnshop offices)” is the result of qualitative research that aims to find out the extent to which fiduciary guarantees are applied in shari‟ah pawnshops, whether it is in accordance with the law or in fact there are still many violations committed, because some cases of fiduciary guarantees are related to the registration process that is not registered at the fiduciary registration office, besides the purpose of this study is to find out the view of Islamic law regarding the practice of fiduciary guarantees in financial institutions.
Dta collection techiqueus were carried out by way of direct interviews with the head of the sharia pawnshop branch office with the aim of digging in-depth information related to the issues raised by the researcher. The collected data is then analyzed using qualitative descriptive analysis methods. Researchers use the interview process and documentation in data collection.
The results of this study indicate that the shari‟ah pawnshop has implemented a fiduciary guarantee system in accordance with the law, whereby the registration process at the fiduciary registration office is regulated directly by a notaray appointed by the pawnshop. In the case of fiduciary collateral registration the shari‟ah pawnshop does not apply a minimum loan amount so that the collateral is registered, because all type of transactions that use fiduciary collateral will be registered at the fiduciary registrations office. In the view of Islamic law fiduciary the object of the guarantee remains with the owner of the goods, whereas in the concept of protection fiduciary assets become an agreement that makes it easy for costumers to be able to improve their economy through business they do.
