PELAKSANAAN PENYELESAIAN SENGKETA KONSUMEN
OLEH LEMBAGA KONSUMEN YOGYAKARTA (LKY)
%X Yogyakarta Consumer Institute (LKY) is a Non-Governmental Consumer
Organization (LPKSM) which according to laws and regulations does not have
the duty and authority to organize consumer dispute resolution. In laws and
regulations, the task and authority to organize consumer dispute resolution is
given to the Consumer Dispute Settlement Agency (BPSK), but in practice LKY
participates in organizing consumer dispute resolution by
conciliation/reconciliation and mediation. This creates problems in the form of
confusion for consumers who want to complain about their disputes with business
actors and the overlapping implementation of the functions and authorities of each
institution in the consumer protection system in Indonesia. This phenomenon can
be studiedwith a review of Islamic law in the theory of 'urf.
This research is a field research, namely research conducted by collecting
data and information obtained directly from respondents. This research is
descriptive and conducted using a juridical and normative approach. The juridical
approach is a problem approach based on statutory regulations. As for the
normative approach is a problem approach based on the norms of Islamic law.
The data in this study are primary data and secondary data. Primary data was
obtained by the compiler by conducting interviews with the institution that
became the object of research. While secondary data is obtained by the compiler
through the official websites of ministries and state institutions, as well as
newspapers on online sites. Data analysis was carried out using qualitative
methods, which emphasized the analysis of the deductive and inductive inference
process as well as on the analysis of the dynamics of the relationship between the
observed phenomena, with scientific logic, namely the theory of 'urf.
Based on the research results, the LKY's actions are one of the efforts of
LKY (as a Non-Governmental Consumer Protection Agency) to defend consumer
rights, in accordance with what is mandated by law. Meanwhile, according to a
review of Islamic law based on the theory of 'urf, the implementation of consumer
dispute resolution by LKY by means of conciliation/reconciliation and mediation
is permissible because it meets the kulliyah rules in ushul fiqh, the criteria of 'urf
sahih, and the principles of dispute resolution in Islam.
