N2  - Trade in ?honorary canteen? at UIN Sunan Kalijaga Yogyakarta that is done by students is quite the unique phenomenon. In fiqh muamalah this kind of trade is called by bai? mu???ah. Ma?hab ulama have different opinions about the legality of this kind of trade as it is viewed as not fulfilling some of the principles and requirement of trade which are there are no face to face interaction between the seller and the buyer which leads there were no ?igat (ijab and qabul) that indicates willingness between two parties. This type of trade has its advantages which are more practical, gave ease also benefit, but there are also downside that is this trade require honesty so there are risks if buyers did not honest.
This research endeavour to answer these questions: why this trade in ?honorary canteen? at UIN Sunan Kalijaga kept going? How the practice of trade had been done? How Islamic sociology of law view this practice of trade? The method used for this research is observation and interview with relevant parties also using sociological approach that has descriptive-analytic characteristic that describe and explain factor that made the practice of trade in ?honorary canteen? at UIN Sunan Kalijaga Yogyakarta possible and then analysed based on Islamic sociology of law perspective.
This research shows result that trade practice in ?honorary canteen? at UIN Sunan Kalijaga is grounded by some factor. Those factors from sellers being the availability of opportunity and chance, a media for learning and get experience in business, develop potential and hobby, maximise leisure time and lastly to help parents economy condition to meet daily needs. As for factors from buyers are the convenience to get food/drinks, more practical and efficient also the product sold are varied and has affordable price. That practice, comprehended with Islamic sociology of law perspective, viewed that trade evolve parallel to students comprehension about validity of trade that regarded in line with sharia with following ma?hab ulama?s assessment that permit as it is viewed as more compatible with today?s context of trade. The existence of this trade is influenced by its sociological environment where students apply behaviours that gave impact on the occurrence of trade with the condition, sellers and buyers need each other so trade occurred, gave benefit, convenience and mutual assistance. Moreover, there is another reason as there is no specific policy or regulation from the faculty nor the university about the trade so it thrived and become a custom in UIN Sunan Kalijaga student environment.
