abstract: Basically, a guardian is not only a condition of a harmonious or legal marriage, but also functions as a protector of women’s rights. The laws and regulations will always change over time, no exception with the regulation of the minister of religion in 2007 which requires guardians to be at least 19 years old, but in 2018 the ministry of religion abolished the minimum limit of 19 years, How can legal considerations abolish the age of the guardian in the current ministerial regulation of religion and consider the benefit of the policy to eliminate the age of the guardian.
This research is literature research with the data analysis method used is a qualitative method by inductive method which is carried out with a philosophical juridical approach using the theory of maslahat.
After the research is done, legal considerations for the abolition of the age limit for guardians were not found because there were no restriction on the age of guardians in higher or earlier legislation, the legislation in Indonesia is also unclear about the age of maturity which ultimately raises pros and cons among KUA and the community. Consideration of eliminating the age of 19 years is more beneficial because the benefits arising from the age limit of 19 years are no longer needed due to developments in society and increasingly advanced laws in Indonesia.
