"ANALISIS MAQASID ASY-SYARIʻAH TERHADAP\r\nPENGEMBANGAN WAKAF DI PONDOK PESANTREN\r\nWALI SONGO NGABAR PONOROGO"^^ . "Pondok Pesantren Wali Songo (PPWS) Ngabar Ponorogo has been\r\nimplementing economic independence as of one of its missions, spirit,\r\nand educational goals to train students to be independent and selfemployed.\r\nThe entrepreneurial practice has been manifested in the\r\neconomic development of pesantren by managing waqf assets as the\r\nprimary economic capital. All pesantren operations are financed by the\r\nprofit derived from the management of waqf assets in some business\r\nunits. Initial waqf assets are preserved as the capital of nadhir\r\n(beneficiary) legality which is utilized in the form of services.\r\nInterestingly, the productivity of economic development is not from\r\nthe initial waqf assets, but from the results of the beneficiary’s\r\nbusiness profit which in total is recognized as the waqf assets of the\r\npesantren, with waqif (a person who does waqf) from the nadhir\r\nmembers themselves. Nadhir who initially consisted of a group of\r\npeople appointed by the waqif then was institutionalized in the form\r\nof a foundation under the name of Majlis Riyasati Ma’had, an\r\ninstitution within the organizational structure of PPWS Ngabar, which\r\nbecomes the highest institution responsible for the continuity of the\r\npesantren in realizing the purpose of waqf according to the mandate of\r\nthe waqif, as well as indicates that PPWS Ngabar is a waqf boarding\r\nschool. However, some of the waqf assets development practices at\r\nPPWS Ngabar has resulted in academic problems. The waqf assets is\r\nnot developed from the initial waqf assets mandated by waqif, but\r\nthere is an acknowledgment that of all pesantren assets serve as waqf\r\nassets, and nadhir members as waqif on nadhir’s business assets. On\r\nthe basis of this problem, an in-depth study is needed in the perspective\r\nof Islamic law from the point of view of maqāsid waqf and maqāsid\r\nsharīʻah by Jasser Auda’s approach, because Auda offers the\r\ndevelopment of contemporary Islamic law that is oriented for the sake of the wider community. This study focuses on the practice of\r\ndeveloping waqf in terms of maqasid waqf and maqasid shariʻah of\r\nJasser Auda with the aim of explaining and analyzing the range of\r\nmaqāsid to the practice of developing waqf assets which are\r\npractically developed with the current model. This is a field research\r\nwith the approach of maqaṣid shariʻah of Jasser Auda. Primary data\r\nwere selected purposively, then analyzed by using qualitative data\r\nanalysis by Miles and Huberman models. The results of this study\r\nexplain that the waqf assets at PPWS Ngabar are developed by the\r\nmanaging waqf assets to ensure the productivity of assets for the\r\nbenefits of pesantren. Hence, as seen from the maqāsid point of view,\r\nthe purpose of the waqf has been fulfilled, in that the initial waqf assets\r\nare directed at the productivity for the benefits of pesantren services.\r\nDoing this management will eternally preserve the initial waqf assets.\r\nMeanwhile, the economic gain of waqf assets is resulted from nadhir’s\r\nbusiness units. The two developments of the assets are interrelated and\r\ninseparable, which support the service and economic benefits of the\r\ninitial waqf assets simultaneously. The institutionalization of nadhir\r\nin the form of a foundation has developed nadhir as waqif, and the\r\nrecognition of all pesantren assets as waqf assets is seen as more\r\nbeneficial and avoids harm. The arūriyāt level on the development of\r\nwaqf is in the category of protecting property (ḥifẓ al-māl), paying\r\nattention to economic development and growth, and supporting social\r\nwelfare. The practice of developing waqf assets in PPWS Ngabar still\r\npreserves the initial maqāsid waqf, but like the Auda paradigm, the\r\nwaqf in PPWS Ngabar also has a productive profit gain orientation that\r\nfor the sake of the wider community, as indicated by the achievement\r\nof waqf goals and expanding its benefits to the economy of the\r\ncommunity surrounding the pesantren. The practice of developing\r\nwaqf assets at PPWS Ngabar cannot be analyzed partially because the\r\ncause and effect are correlated. This will go against the perspective of\r\nclassical waqf fiqh. Thus, analyzing it with the Auda system approach\r\nwill reveal that the practice of gaining profit through waqf assets in\r\nPPWS Ngabar has met the legal ground, and has met the maqāsid waqf\r\nand maqasid shariʻah. Theoretically, this research contributes to the reach of maqasid shariʻah, especially based on the Jasser Auda’s\r\napproach to the practice of developing waqf assets which has been\r\npractically applied with a contemporary model that leads to\r\nproductivity and benefits for the wider community. This research\r\nreveales the necessity to redefine nadhir and the conditions that\r\nsupport it to ensure that it is in accordance with the meaning of\r\nproductive waqf assets which has become the spirit of the waqf law in\r\nIndonesia."^^ .
