N2  - The sophistication of information technology in addition to providing convenience and benefits for human work can also provide harm to its users. One of them is that there is a criminal act of defamation which is regulated in Law Number 11 of 2008 concerning Information and Electronic Transactions. In the settlement of criminal acts of defamation at the police level, investigators can use non-litigation channels, namely by means of mediation and with the principle that criminal law is the ultimum remidium in law enforcement. Based on the data obtained by the compilers of the Yogyakarta Special Region Police, it is known that in the last 2 (two) years, criminal acts of defamation have increased, namely in 2019 there were 46 cases of defamation, while in 2020 there were 84 cases. In addition, mediation in the criminal act of defamation at the Yogyakarta Special Region Police is included in the new policy by the Chief of Police as issued by the Circular Letter of the Chief of Police Number 2 of 2021.
The type of research used in the preparation of this thesis is a type of field research and is descriptive-analytical in nature with a juridical-empirical approach. The data used in this study are the results of interviews with the Yogyakarta Special Region Police and use written sources and statutory regulations. The two theories used by the authors as an analytical tool are the theory of restorative justice and the theory of legal benefit.
The results obtained by the authors related to mediation of criminal acts of defamation at the Yogyakarta Special Region Police, namely that the mediation carried out by the police was in accordance with the Circular Letter of the Chief of Police Number 8 of 2018 and Circular of the Chief of Police Number 2 of 2021 and guided by Decree 3 ( three) Ministers, namely the Ministry of Communication and Information, the Indonesian National Police and the Indonesian Attorney General's Office. Mediation carried out at the Yogyakarta Special Region Police was carried out in 2 (two) stages, namely the first was carried out in the investigation process and the second was carried out in the summons process at the investigation level.
