%X PT Aplikasi Karya Anak Bangsa is a company that is engaged in the  technology field of Gojek, trademark owner registered in the Direktorat Jendral  Kekayaan Intelektual Republik Indonesia. This research aims to determine the legal  status for the fake order action in relation to the Gojek partnership agreement.  This research is qualitative study conducted with field research method and  supported by the library research. The interviewees of this research are drivers and  customers that help the drivers to carry out a fake order. Then the practice of fake  order is linked to the Gojek partnership agreement . The sampling method of this  research is random sampling. The sample is consisted of 8 drivers and 8 customers  who help drivers. The data collection techniques used were interview, observation,  with supported by library research.  The results of the study showed that the practices of fake order are exist  untill today. The factor is the consideration of the driver who is actually waiting for  points on that day, because not every day the driver is adequate to achieve the target  points. In accordance with the civil law fake order is not included into the default  action because in the clauses of agreement were not discussed it spesifically, on the  contrary, the normative law allows it under the condition that the driver still runs  the order according to the procedure.
