Ahmad Bahiej, S.H., M.Hum. abstract: Corruption is an act against the law with the intention of enriching oneself/others, both individuals and corporations, which can harm state finances/state economy. Eradication of criminal acts of corruption in Indonesia is still carried out conventionally, namely finding the perpetrators of criminal acts and imposing imprisonment (follow the suspect). When viewed from the Indonesian corruption perception index in 2020 which fell to 102 out of 180 countries, it proves that there is a lack of effectiveness in eradicating corruption in Indonesia. It is considered less effective because the imposition of a crime is not followed by an attempt to confiscate the proceeds of a criminal act of corruption. So that perpetrators of criminal acts of corruption can still enjoy the results of criminal acts that have an impact on state financial losses. When compared to the United States, The corruption perception index in 2020 is at number 25 out of 180 countries. Of course the achievement is very far from Indonesia. In eradicating corruption, the United States applies the asset forfeiture without punishment or Non-Conviction Based (NCB) Asset Forfeiture. This type of research is library research with the nature of the research is descriptive legal research. The research approach used is a legal approach and a comparative approach. Data collection techniques are carried out by reading, studying, and studying various books and other sources. After the data is collected, the data analysis technique with the inductive method is used. The results of the study indicate that the differences in the seizure of assets from criminal acts of corruption in Indonesia and the United States can be seen in 3 (three) different categories, namely the type of asset forfeiture, the mechanism for asset forfeiture, and the conditions under which civil forfeiture of assets is applied. Regarding the asset forfeiture model using the Non-Conviction Based (NCB) Asset Forfeiture which is in accordance with the justice system in Indonesia, the asset forfeiture mechanism model is contained in the RUU Perampasan Aset Tindak Pidana. In the draft legislation detailed arrangements regarding the mechanism for asset confiscation, asset management, compensation, protection for third parties with good intentions, and funding.
