"Since the late 1980s, there have been responses of discontent\r\nand criticism to Bahtsul Masail, especially in his methodological\r\naspects. Although the methodological framework was formulated in\r\n1992, criticisms and pressures on renewal to Bahtsul Masail are still\r\nhappening. To respond to this, this research takes the theme of fiqh\r\ncriticism of NU reasoning in Bahtsul Masail. This study considers\r\nthat the renewal of the Bahtsul Masail must be done through\r\nepistemological critique activity, through a balanced reading of the\r\n\"surface narrative\" and \"unreadable reality\" of Bahtsul Masail. On\r\nthat basis, this study answers three operational questions, i.e., about\r\n(1) the thinking tradition of NU kiai as the interpreters of the kitāb\r\nkuning (old books) in Bahtsul Masail, (2) the genealogical roots and\r\nthe process of the formation of NU reasoning, and (3) the theoretical\r\ncontribution of the fiqh of NU against madhhab (schools) and Uṣūl\r\nal-fiqh (Islamic jurisprudence), and on experimentation of Bahtsul\r\nMasail’s epistemic renewal.\r\nTo answer the problems, this research uses a qualitative method\r\nthat is interdisciplinary. In addition to the hermeneutic perspective,\r\nthis study also uses structuralist analysis of Muḥammad 'Ābid al-\r\nJābirī. The hermeneutical perspective is used to read the thinking\r\ntraditions of NU kiai in Bahtsul Masail while structuralist analysis of\r\nal-Jābirī, supported by historical analysis and ideological criticism, is\r\nused to examine the genealogical roots and the process of NU\r\nphilosophical reasoning, on the one hand, and to identify the Bahtsul\r\nMasail’s epistemic problem as a foothold of reform, on the other.\r\nThe results of this study indicate that Ahlussunnah wal Jama'ah\r\n(Aswaja) and traditions of following madhhab is as the reason of the\r\nfiqh of NU in Bahtsul Masail to have dialectics between conservation\r\nand accommodation changes. This is reflected in the flexibility and\r\neclecticism in the selection and interpretation of the old texts and the\r\ntradition of manhajī thinking behind the the qaulī method used.\r\nGenealogically, this thinking tradition was rooted in the Wali Songo\r\ntradition of thinking and the Middle Eastern scholarship traditions\r\ntransmitted through the pesantren tradition as the cultural basis of\r\nNU. However, the tradition of thinking of NU kiai in Bahtsul Masail\r\nalso experienced epistemic problems, as a result of the epistemic\r\nchanges of the pesantren tradition in the colonial era. The dialectical relationship between conservation and change is still not balanced, as\r\nchange is still being made in the orientation of protection against\r\ntradition to be relevant to modernity. On that basis, the orientation of\r\nthe protection must be supplemented by the development orientation,\r\ni.e., by revising the grand design of the methodology framework of\r\nBahtsul Masail’s istinbāṭ by maximizing the problem analysis\r\nframework and collective work system (jamā'ī). The goal is to realize\r\na multidisciplinary and development-oriented Bahtsul Masail (alījād)\r\nthat is more fundamental to society.
