%X The formation of Ministerial Regulations/Heads of Institutions often creates problems both in government and in society. The President as the Head of Government also complained about this problem. In response to these problems, the President issued a policy in the form of Presidential Regulation Number 68 of 2021 concerning Granting Presidential Approval to Draft Ministerial Regulations/Heads of Institutions. This Presidential Regulation requires the draft Ministerial Regulation to obtain prior approval from the President before being stipulated by the initiating Minister. However, there are some writers' concerns about some of the processes for granting the President's approval which are still abstract. In addition, several provisions in this Presidential Regulation also contradict each other. From this concern, the author is interested in conducting research on Presidential Approval in the Formation of Ministerial Regulations using the Siya'sah Dusturiyyah Perspective.
The type of this research is library research using a juridical-normative approach that relies on the main legal materials by examining theories, concepts, legal principles and laws and regulations related to this research and then systematically presented. through various literary sources that are guided by the legal norms and hierarchies contained in the applicable laws and regulations.
The results of this study indicate that the provisions stipulated in Presidential Regulation Number 68 of 2021 raises several new problems. Both the implementation of the Presidential Regulation and the resulting Ministerial Regulation. In addition, the provisions stipulated in Presidential Regulation Number 68 of 2021 contradict the concepts, rules of Fiqhiyyah Kuliyyah, and the principles used in Siya'sah Dusturiyyah. These problems show that it shows that Presidential Regulation Number 68 of 2021 or the policy of President's approval in the formation of Ministerial Regulations is not effective in overcoming the problems of Ministerial Regulations..
