N2  - Simultaneous Elections in Indonesia are still a problem, because the provisions of Articles 167 and 347 of Law Number 7 of 2017 concerning General Elections are still considered contrary to the 1945 Constitution, therefore this research will seek to analyze the decision of the Constitutional Court Number 16 / PUU-XIX / 2021 concerning the Importance of Elections from the perspective of Siyasah Syar'iyyah. The research questions will be studied using two perspectives, namely legal certainty and siyasah syar'iyyah.
This type of research is library research using primary legal materials including the 1945 Constitution of the Republic of Indonesia, Law Number 7 of 2017 concerning General Elections, and constitutional court decision Number 16 / PUU-XIX / 2021 concerning Elections. Secondary legal materials include books related to simultaneous elections, articles related to the position of Law Number 7 of 2017 concerning Simultaneous Elections. Meanwhile, tertiary legal materials are materials that can provide clues about this research which are descriptive-analytical with the method of collecting systematic literature study data, as well as data analysis in this study using analytical descriptive methods.
The results showed that the material test of Articles 167 and 347 of Law Number 7 of 2017 concerning Elections was not actually contrary to the 1945 Constitution, but the implementation system needed to be evaluated. Then, the decision of the Constitutional Court Number 16/PUU-XIX/2021 is actually not contrary to the principle of siyasah syar'iyah, this is based on the election of the head of state and the formation of laws should have the qualifications of strength (al-Quwwah) and integrity (al-Amanah).
