"This dissertation examines the phenomenon of family law in\r\nmiddle-class muslim society in Banyumas and its relation to\r\nreligious understanding and state law. This study argues that the\r\npresence of middle-class Muslims has an influence on legal changes\r\nin society. This study specifically aims to understand the dynamics\r\nof family law in middle-class muslim societies, to analyze the role of\r\nagents and structures in constructing Islamic family law discourses,\r\nand to examine the extent of the state's role in mainstreaming\r\nequality in Islamic family law discourses in middle-class muslim\r\nsocieties amidst the flourishing and diverse religious authorities.\r\nAs field research, the primary data were collected directly in 3\r\n(three) methods, namely observation, in-depth interviews, and\r\ndocumentation. Researchers conducted participatory observations of\r\n6 (six) study forums held by urban mosques, namely the Jenderal\r\nBesar Soedirman Mosque, Purwokerto, the Fatimatuzzahra (Mafaza)\r\nMosque, the Gelora Indah Mosque, Purwokerto, as well as several\r\nmosques located in some elite housings, namely the Griya Asri\r\nHousing Mosque, the Griya Satria Housing, and the Sapphier\r\nHousing Mosque. In addition, researchers also made observations in\r\n3 (three) Offices of Religious Affairs and 2 (two) Religious Courts,\r\nnamely The Religious Court of Purwokerto and the Religious Court\r\nof Banyumas. The researcher interviewed 31 informants, who were\r\neventually reduced to 26 informants. The primary data in this\r\ndissertation were supported by some documents, including the\r\ndecisions of the Religious Courts and the Office of Religious Affairs\r\nas well as other data in the form of journals, books and annual\r\nreports. This research was conducted using socio-anthropological\r\napproach. It applied Anthony Giddens' structuration theory and Max\r\nWeber's authority theory as the grand theory and Abdullah Saeed's\r\ntheory of religious understanding as the supporting theory.\r\nThis research revealed 3 (three) important findings. First, there\r\nhave been some notable dynamics of family law understanding and\r\npractice in Banyumas, as indicated by groups that reject equality, groups that are fairly accommodative, and the contextualistprogressive\r\ngroups that accept equality. Of the three models, the first\r\ntwo models are more dominant in the middle-class muslim\r\ncommunity in Banyumas. This argument is built based on three\r\nfamily law issues, namely the problem of husband-and-wife\r\nrelations, divorce, and polygamy. Second, the dynamics of Islamic\r\nfamily law in the middle-class muslim community in Banyumas is\r\ninseparable from the aspect of the subject (the community) who\r\ntends to have a symbolic understanding of religion and refers to\r\ntextual religious motivations. In addition, it is also influenced by\r\nagents mainly ustadz who have certain religious affiliations, female\r\npreachers, and ustadz with textualist perspective who gained\r\npopularity in the media. The social structure also plays an important\r\nrole, such as urban mosques and residential mosques that actively\r\nconduct studies, as well as family law advocacy such as the existence\r\nof the Munakahat School program and marriage counseling. Third,\r\nthere has been a limited role of the state in shaping the understanding\r\nand behavior of modern family law, which considers justice for\r\nwomen. This can be seen in the relationship between men and\r\nwomen and polygamy. In addition, the presence of religious\r\nauthority in society plays more essential role in shaping public\r\nunderstanding of family law than the role of the state. The muslim\r\nmiddle class group seems to prefer charismatic authority to others.\r\nIn general, this study provides a theoretical contribution by adding\r\nnew elements to Giddens' theory in the context of understanding an\r\naction or behavior, namely belief, as well as reflection,\r\nrationalization, and motivation. Meanwhile, in practice, the effort to\r\nrealize legal understanding and practice in a society that is more\r\nmodern and upholds egalitarian principles can be done by advocating\r\nfor agents of religious narrative."^^ .
