N2  - KPU Regulation (PKPU) Number 13 of 2020 is a legal product issued by the KPU RI in the technical context of holding regional head elections in the midst of the COVID-19 Pandemic and in the midst of implementing Government Regulation Number 21 of 2020 concerning Large-Scale Social Restrictions. PKPU Number 13 of 2020 comes as a form of bargaining against PP Number 21 of 2020 so that the regional head election which the government is planning to continue does not violate ongoing regulations, does not violate rules such as continuing to implement the Health Protocol, wearing masks, disinfectant, disposable gloves, hands sanitizer, does not violate mass gatherings, and so on.
This paper examines how the validation of fiqh principles applies to Government Regulation Number 21 of 2020 and KPU Regulation Number 13 of 2020 in the Blitar Mayoral Election during the COVID-19 Pandemic, as a study of Islamic law on the practice of Constitutional Law carried out by election institutions in Indonesia.
This type of research is field research, which is descriptive-analytical in nature with a juridical-empirical approach and uses secondary data (materials taken from various literature, laws) and primary materials (data obtained from the field).
The results: 1. PKPU Number 13 of 2020 does not violate the above law, namely PP Number 21 of 2020. The regional head election went well without violating the Health Protocol and there were no new clusters (election clusters). KPU Regulation Number 13 of 2020 brings benefits to the effectiveness of holding Regional Head Elections in the midst of the COVID-19 Pandemic. 2. In the Perspective of Qaw?`idul Fiqhiyyah, the PKPU clearly contains a much larger and more general overall maslahah which is obligatory to be implemented first because, the appointment of a leader is mandatory.
