        abstract = {The application for a marriage dispensation has been regulated in Article 7
paragraph (2) of Law no. 16 of 2019 concerning changes to Law no. 1 of 1974
concerning Marriage. An application for a marriage dispensation can be filed in court
with urgent reasons and sufficient evidence. The meaning of the phrase very urgent
reason is the reason there is no other choice, and it is very forced to have a marriage.
However, the judge's decision to grant permission to marry dispensation was still
based on consensual considerations. This provision emerges a paradigm that the rules
regarding the concretization of very urgent reasons in the case of an application for
dispensation from marriage are unclear.
This type of research was library research supported by field research, with a
juridical approach, normative approach and philosophy. The data analysis method
used was descriptive analysis. Methods of data collection using documentation and
interviews.
The study results showed that the reasons underlying the Judge of the
Syar'iyah Court of Takengon granted it by considering two main factors: juridical
and sociocultural factors. The basis of the argument used is parental responsibility
and juvenile delinquency. Then, when viewed from normatif the Judge?s grants the
decision by reasons and conditions are intereleed. When viewed from Jeremy
Bentham's legal benefit theory, the Judge's consideration in granting the request for a
marriage dispensation has provided benefits (happiness) for both the parties and the
wider community. This can be seen by achieving the parties' wishes and fulfilling
human rights (HAM) and public order. The granting aims to deny a greater affliction.}
