%X One of the violations of constitutional rights is the right to be free from threats, discrimination and violence. One form of violation is sexual violence, especially against women. The impact on victims is not only physical but also psychological, psychological trauma. The state in solving the problems of violence has made various efforts to prevent or overcome them. In general, several types of sexual violence as a criminal law have been regulated in the Criminal Code and the Criminal Procedure Code, which are then also scattered in several sectoral regulations, but the existing laws and regulations have not fully responded to the facts of sexual violence. occur. With the existence of the Sexual Violence Crime Act to provide justice for victims of sexual violence. In this study, the authors formulated two problem formulations. First, does the Law on Sexual Violence provide fulfillment of the rights of women as victims of sexual violence, second, are the rights of women as victims of sexual violence regulated in the Law on Crime of Sexual Violence in line with Maqasid Asy-Syariʻah.
Research using library research methods (library research). And the nature of the research in this thesis is descriptive analysis research. This thesis is a normative legal research (juridical normative) which examines literature with a secondary data base, using various approaches including: 1) case approach; 2) the statutory approach (statue approach); 3) conceptual approach (conceptual approach) by describing concepts and theories.
The results of the study based on the analysis concluded that. First, the Law on Sexual Violence has provided fulfillment of the rights of women as victims of sexual violence, namely, the right to treatment, the right to recovery, the right to protection. Second, in the view of Maqaṣid Asy-Syariʻah the rights granted in the Law are in line with the objectives contained in Islamic shari'ah, namely in accordance with the principles of Maqasid Asy-Syariʻah including maintaining Religion (Hifẓ ad-Din), offspring (Hifẓ an-Nasb), nourishes the soul (Hifẓ an-Nafs), guarding the mind (Hifẓ al-Aql), protecting property (Hifẓ al-Mal)
