abstract: Constitution Number 3 of 2022 concerning the State Capital which was ratified on January 18, 2022 has problems in the process of its formation. Constitution This legalized in short time in 43 days since discussed. Contains 11 chapters and 44 chapters assembled affairs moving the capital to Kalimantan. In the process of forming Constitution Number 3 of 2022 concerning the State Capital raises polemic in society. Because no in accordance with principle Formation Regulation Legislation that has contained in Constitution Number 12 of 2011 concerning Formation Regulation Legislation. As has been stated in the Constitution The number 12 of 2011 that formation process must fulfil a number of principle. One of them participation society, which should be open For society for society can obtain accurate, honest and transparent information.

Method data collection through studies References (library research) related with participation public in formation Constitution Number 3 of 2022 concerning State Capitals perspective Siyasah Dusturiyyah. All data collected Then analyzed in a manner qualitative.
Research results show that in the formation of Law Number 3 of 2022 concerning State Capitals, the principle of openness was not applied as meant in Law Number 12 of 2011 concerning the Establishment of Legislation due to the lack of transparency and information disclosure to the public, and obliging the public to participate in providing input orally or in writing at each stage, but this did not occur and was not realized in the process of establishing Law Number 3 of 2022 concerning the State Capital.
