N2  - One of the consequences of holding simultaneous local elections nationally in 2024 is the vacancy in the position of regional head. The 2024 simultaneous local elections resulted in the vacancy of the positions of 271 regional heads, both governors and regents/mayors. One way that the Ministry of Home Affairs has done in this regard is to appoint Acting Heads of Regions. This is to ensure that the wheels of government in the regions continue to run until the implementation of the 2024 simultaneous regional elections. However, this provision raises polemics in the community, because unilateral appointments without a democratic mechanism are prone to abuse of authority and conflicts of interest, and override the Constitutional Court's decision Number 15/PUU-XX/2022. From the description above, the author is interested in examining how Siya<sah Syar'iyyah's analysis of the appointment of acting regional heads
This thesis is normative legal research (normative juridical), namely approach research that is carried out based on the main legal materials by examining the theories, concepts, and legal principles and laws and regulations related to this research. With the nature of analytical descriptive research using statutory approach (statue approach), case approach (case approach), and conceptual approach (conceptual approach). Research data collected through text reading which is then described and analyzed using the leadership theory of Ibn Taimiyah and Mas}la}hah.
The results of this research are: 1). In Ibnu Taimiyah's leadership concept, the appointment of acting regional heads is appropriate considering that there is a vacancy in regional head positions due to the simultaneous local election law policy in 2024 to ensure that the wheels of government in the regions can run until a definitive official is elected. However, in the leadership concept of Ibnu Taimiyah, the leader who is appointed must involve the people in the process, so that it can be said that the mechanism for appointing the acting regional head is not in accordance with what Ibnu Taimiyah wants. 2). The Constitutional Court Decision Number 15/PUU-XX/2022 fulfills two basic principles of Mas}la}hah, namely cases not found in the Qur'an or Hadith and bringing solutions for the common good.
