%X Between Indonesia and Turkey, there are many similarities, such as both being democratic republics and countries with a long history of changing the form of a state into a unitary state. Since the 2017 referendum, Turkey has changed its constitution by abandoning the parliamentary system, which has influenced changes to several of its constitutional systems. Meanwhile, Indonesia also underwent several constitutional amendments before returning to the 1945 Constitution. Based on the many fundamental similarities between Indonesia and Turkey, it is interesting to study this comparative study, especially regarding the system of government and division of powers based on the constitution they adhere to.
This type of research is normative juridical research, with data sources obtained from literature or library research, namely the primary data are laws and regulations, as well as an analysis of the constitution of the Republic of Indonesia, namely the 1945 Constitution and Turkey, namely the 1982 Constitution, as well as secondary data obtained from including legal texts in the form of books, journals and others.
The results of this study indicate that both Indonesia and Turkey in their respective constitutions apply the principle of checks and balances, namely the division of powers into 3, namely the legislature, executive and judiciary. However, there are some differences such as in the executive branch the authority of the Turkish president is broader than Indonesia, in the Turkish legislature it is possible to oversee the performance of the President while in Indonesia it is not because the legislature, executive and judiciary are equal and in the judiciary there is a separation of the judicial commission from the judiciary. judiciary in Turkey to remain independent, while in Indonesia it is not.
