This change is because the infidel status is no longer used in the modern state system. On the other hand, the participation of PBNU members who participated in the batsul masail maudluiyyah session is a sign that the issues being discussed are central because they involve issues of citizenship. This study aims to analyze the participants' agency in the batsul masail maudluiyyah trial and analyze these changes within the framework of Islamic constitutionalism. This research is a qualitative study. The subjects of this study were the participants in the maudluiyyah trial who were taken by four figures, namely KH. Abdul Moqsith Ghazali, KH. Masdar Farid Masudi, KH. Said Aqil Siradj and KH. Yahya Cholil Staff. The data search method uses documentation of the results of the 2019 NU National Conference forum in Banjar. This data is also the primary data in this study, while the secondary data comes from books, journals, and reports related to the NU National Conference in Banjar. There are two theories used in this study, namely the social agency theory of Pierre Bourdieu, which is used to analyze the participants in the maudluiyyah trial, and the theory of Islamic constitutionalism by Abdullah Ahmed An Naim, which is used to analyze citizenship rights in Islam. This study found that the agency of the maudluiyyah trial participants was formed through habitual space. The trial participants have two types of capital at stake: cultural and symbolic. Their cultural capital comes from Islamic boarding schools and universities, while their symbolic capital comes from their proximity to NU charismatic clerics such as KH. Ali Maksum Krapyak and KH. Abdurrahman Wahid. Ownership of this capital is at stake in the batsul masail arena and results in recommendations to change the status of non-believers to non-Muslims. Second, the change in status was made to conform to the modern constitution. The use of infidels in the state indicates the existence of a class of citizenship based on religion, which has been used since the caliphate era. The change in status to being a citizen is a consequence of the change from the caliphate system to a nation-state system. The implication is that all citizens have the right to get life guarantees, protection, economy, offspring, and other guarantees.
