H. abstract: The latest feature in the TikTok Affiliate Program is the agency partner feature (Multi-Channel Network) which has the advantage of being able to increase the number of viewing algorithms and sales promotions belonging to affiliate marketers. In terms of problems with this practice, the author examines legal protection for parties, especially for affiliate marketers and a review of Islamic law regarding affiliate practices in the TikTok Affiliate Program. This study uses a type of library research. The nature of qualitative research with the approach of Islamic Law and Indonesian Positive Law. The research approach uses an empirical normative research approach. The data search technique that the authors use is through literature studies and interviews. The results of this study show that the practice of the TikTok Affiliate Program in a review of Islamic law is included in the akad ju’a>lah . If a default occurs, it can be resolved with the National Sharia Arbitration Board or through the Religious Courts, as stated in the Fatwa of the National Sharia Council Number 62/DSN-MUI/XII/2007. In Indonesian positive law, agreements in the practice of the TikTok Affiliate Program use standard clause provisions that put the affiliate marketer in a weak position if there is a violation. Reviewing legal protection for affiliate marketers if there is a violation of the obligations of the agreed agreement contained in the contents of the agreed agreement. As in the principle of pacta sunt servanda where an agreement that has been agreed has the status of a law for the parties in it.
