abstract: This study discusses the istinbath method of MUI fatwa law, Bahtsul Masail PWNU East Java and Majlis Tarjīh PP Muhammadiyyah on Crypto Currency. One of the things that is of concern is the use of cryptocurrency as a legal currency that is illegal and lawful to be traded as an asset and commodity, representatives from the Nahdatul Ulama branch (PCNU) and several Islamic boarding schools in East Java decided that the law on using cryptocurrency as a transaction tool is haram. , the Tarjīh and Tajdid Councils have issued a fatwa on the prohibition of crypto (crypto-money law) both as investment activities and as a medium of exchange. This is what makes researchers want to discuss the legal istinbath of the fatwa.
This research is a type of library research. This research is descriptive analytical. In terms of Crypto Currency, the three legal istinbath methods have different views. The MUI fatwa issued a fatwa in 2018 that Crypto Currency is not allowed as a legal tender in Islam, because it has no clear legal basis. Bahtsul Masail East Java PWNU has not issued a specific fatwa on Crypto Currency, but refers to Islamic principles of fair trade and avoiding speculation. Meanwhile, the Majlis Tarjīh PP Muhammadiyah is of the opinion that the use of Crypto Currency is permissible in Islam as long as it is not used for unlawful activities such as speculation and money laundering. As for suggestions from the drafters, it is best if the MUI, East Java PWNU and Majlis Tarjih PP Muhammadiyah are quicker in posting their fatwa decisions on their website along with the legal sources used, so that we as students can learn more from trusted sources.
