description: Nusyuz according to Prof. Alimatul Qibtiyyah is a form of non-compliance with family values and most people do not fully understand the meaning of nusyuz itself. Nusyuz can lead to conflict between husband and wife. Prof. Alimatul Qibtiyyah in her thinking shows that the concept of nusyuz and its resolution often dominates men over women or is more likely to be addressed only to wives who do not obey the husband's orders, giving rise to inequality of rights and obligations in the balance of husband-wife relations.  This type of research is field research with an empirical juridical approach. While the analysis method used is descriptive qualitative. In the data collection method, the authors used interviews and documentation. The theories used to analyze the problem are maqashid shari'ah theory and gender theory.  The results showed that, according to Prof. Alimatul Qibtiyyah, nusyuz is a defiance of family values that have been agreed upon and the solution is not to immediately separate the bed and then hit, but it should be preceded by discussing together and a second honeymoon with the intention of bringing hearts closer. Istinbath law used by Prof. Alimatul Qibtiyyah regarding nusyuz in a gender perspective has an equal position before the law, then in its implementation there is no unilateral discrimination allowed in the household ark.
