N2  - There have been many public responses regarding dropship
buying and selling, some agree and some disagree, what is
really taken into consideration is the ownership of the goods
in the sale and purchase agreement. Analyzing dropship
problems, researchers focused on three main problems,
namely how to implement dropship in DSN-MUI fatwa No.
145/DSN-MUI/XII/2021, what is the legal protection for
consumers in buying and selling using the dropship system,
as well as how to analyze dropship from an Islamic legal
perspective in this fatwa.
Analyzing the dropship problem, the researcher
focused on three main issues, namely what the dropshipper's
responsibilities are in the event of a default, what legal
protection is for consumers in buying and selling using the
dropship system, and how to analyze the fatwa.
This type of research is library legal research which is
carried out by examining library materials or secondary data.
The approach used in this research is a normative legislative
or juridical approach, which examines the problem of the
dropship system and is based on the legal rules that apply in
Indonesia, in this case Islamic law.
The research results show that legal protection for
perpetrators of buying and selling transactions is regulated
through khiyar. In Islamic jurisprudence related to muamalah,
it is explained and emphasized that the right of khiyar will be
mandatory in a transaction to protect each party from regret
and losses that may be caused by the transaction. The right to
khiyar in point six (6) of DSN-MUI fatwa no. 145/DSNMUI/
XII/2021 was not implemented properly due to the long
refund process as well as the return and delivery process
using personal funds so that buyers felt disadvantaged.
