N2  - The followers of Rifa?iyah in Adinuso village have a distinctive characteristic in conducting marriage ceremonies, which is performing the marriage contract (ijab qabul) twice. Firstly, the ijab qabul takes place at the Office of Religious Affairs (KUA) with an appointed official, and secondly, the ijab qabul is conducted with a Rifa'iyah cleric. They refer to this second ijab qabul as ???i??a??.The implementation of ??i??a? differs from the usual ijab qabul because they have their own standards of marriage validity, which must comply with the requirements stated in the book Tabyin Al-Islah. Additionally, both prospective spouses are required to study the book Tabyin Al-Islah or the books Munakahat and Takhyirah Mukhtashor before the wedding ceremony. This research aims to answer the following questions: 1) How is the validity of marriage in the tradition of ijab qabul ??i??a? practiced by the followers of Rifa'iyah in Adinuso, Batang? 2) What are the perspectives of 'urf (customary practices) and the sociology of Islamic law regarding the validity of marriage in the ijab qabul ??i??a? in Adinuso, Batang?
This research is a field study conducted using the approach of sociology of Islamic law. Data collection was obtained through interviews and relevant books related to ijab qabul ??i??a?. Interviews were conducted with Rifa?iyah religious figures and individuals involved in ijab qabul ??i??a? using open-ended questions, while the books related to ijab qabul ??i??a? are Kitab Tabyin Al-Islah and Takhyirah Mukhtashor. The analytical descriptive method was employed, utilizing the theories of ?urf (customary practices) and the sociology of Islamic law. In the analytical and empirical approach, the sociology of Islamic law studies the mutually influential interaction between Islamic law and other social phenomena. On the other hand, 'urf refers to what is known and becomes a tradition for humans, including speech, actions, prohibitions, and customs. ?Urf is also one of the methods of deriving Islamic law (istinbath).
The research findings indicate that the validity of marriage according to Rifa'iyah is a marriage that is recognized as valid both religiously and legally. This can be observed through a series of ijab qabul ??i??a? traditions practiced by the followers of Rifa'iyah in Adinuso village. They consider a marriage to be valid when its essential requirements are fulfilled as stated in the book Tabyin Al-Islah. Additionally, there are other conditions that must be met, such as the study of the book Tabyin Al-Islah by both prospective spouses before the wedding ceremony, as a preparation of knowledge for building a household. The reading of the book Takhyirah Mukhtashor by both prospective spouses before the ijab qabul serves as evidence that they are truly practicing Islam. The tradition of ijab qabul ??i??a? in Islam is considered a valid customary practice (?urf shahih) that is allowed to be performed, as the series of traditions within ijab qabul ??i??a? do not contradict Islamic law. Through ??i??a?, it is evident that there is harmony between religious teachings and social practices among Muslims, represented by the tradition of ijab qabul ??i??a? that still exists and is practiced to this day.
