abstract: Not a few decisions by Religious Courts in cases of children's origins, even those determined by the same court, differ from each other. Among them are two Determinations of the Batang Religious Court, namely the Determination of the Batang Religious Court Number 242/Pdt.P/2023/PA.Btg and the Determination of the Batang Religious Court Number 216/Pdt.P/2023/PA.Btg. The case in the two Determinations is the same, namely the case of validating the origin of the child in a private marriage where at the time of the marriage the applicant was already pregnant. In the Batang Religious Court Determination Number 242/Pdt.P/2023/PA.Btg the application was rejected, while in the Batang Religious Court Determination Number 216/Pdt.P/2023/PA.Btg it was granted. This research analyzes the judge's considerations in these two decisions. This research problem is formulated in the following questions. (1) What are the factors causing the difference in the content of the determination between the Batang Religious Court Determination Number 242/Pdt.P/2023/PA.Btg and the Batang Religious Court Determination Number 216/Pdt.P/2023/PA.Btg?
