Brunei Darussalam is a monarchy led by a Sultan. The Constitution of Brunei consists of the Basic Law, various laws, regulations, orders, and traditions based on Islamic principles. Brunei's governance system is based on principles provided by Islam, and the Sultan is the head of state and government. Although Brunei has a parliament, the Sultan substantially holds power in legislation, judiciary, and executive matters. The Constitution of Brunei is based on Islamic law principles and policies set by the Sultan. The Constitution of Brunei is based on the principles of Islamic Sharia. Brunei Darussalam is a country that applies Islamic law in various aspects of its societal life. As a monarchy with a governance system based on Islam, Brunei integrates Sharia principles into the formation of laws, policies, and state institutions. The application of Sharia law in Brunei encompasses various areas of life, including criminal law, family law, public morality, and government administration. For example, Sharia criminal law in Brunei may include punishments such as whipping and death penalty for certain offenses. The findings of this research show that the principles of Islamic Sharia are the main foundation of the Constitution of Brunei and influence all aspects of life in the country, including governance structures, legal systems, and social policies. In the context of Brunei, laws based on Maqasid Sharia aim to achieve the common good, social justice, and moral well-being of society.
