abstract: Javanese people in general still believe in and adhere to customs that have existed since ancient times. In Magetan, there are people who still maintain the Jilu or Lusan custom, where if this custom is violated, the people there believe that it will bring disaster. This causes some parents to refuse to be their children's marriage guardians, so the children use adhal guardians. One example of an adhal guardian's request on customary grounds, namely regarding the prohibition on marriage of first and third children or Jilu, is in the Magetan Regency Religious Court, namely in decision no. 0065/Pdt.P/2020/Pa.Mgt.
This type of research is library research with a normative juridical approach, the nature of the research uses descriptive analysis, namely describing the determination of the judge of the Magetan Religious Court in granting the guardian's request on the grounds of the Javanese Siji Telu custom. Data collection techniques use interview and documentation methods. And data analysis aims to obtain information as a basic reference in solving a problem. In this research, the data analysis used is by systematically searching or compiling data obtained from interviews, or other materials.
The research results that have been obtained. First, the judge's considerations in the decision were based on Islamic law and positive law, the judge set aside customary interests under Islamic law and positive law so as not to cause harm. Second, the results of the analysis of decision No.0065/Pdt.P/2020/PA.Mgt when viewed from the theory of justice and Maslaḥah Murlah's perspective relate to the theory of justice of the judge's efforts to ensure that the decision is in accordance with the rules and in accordance with legal principles by still considering the impact or implications in the long term and from the perspective of Maslaḥah Murlah, the decision is in accordance with Maslaḥah Dhuriyat, namely benefit in the maintenance of reason, lineage, religion and property
