%X This study aims to find out the legal considerations used by the judges of the Yogyakarta Religious Court in deciding divorce cases caused by husbands who have changed religions. The Panel of Judges in deciding case number 617/Pdt.G/2021/PA.Yk, namely by imposing divorce one bā'in ṣughrā of the defendant against the plaintiff.
The type of research used is field research, and is supported by literature studies from several documents such as books, journals, articles, scientific papers or other research. This research uses a normative juridical approach. The data analysis method used is descriptive analytical obtained from interviews and literature studies.
The results of the study concluded that: The legal considerations used by the Panel of Judges in deciding Case Number 617/Pdt.G/2021/PA.Yk, namely based on Article 39 of Law Number 1 of 1974 concerning Marriage in conjunction with Article 19 letter f of Government Regulation Number 9 of 1975 concerning the Implementation of Law Number 1 of 1974 in conjunction with Article 116 letter h where in the decision the Panel of Judges emphasized the reasons for divorce due to continuous disputes and quarrels caused by the defendant's conversion. Thus in this case the Panel of Judges did not impose a decision of fasakh but imposed divorce one bā'in ṣughrā.
