description: This study discusses legal protection for children who are victims of bullying  according to the Positive Criminal Law and Islamic Criminal Law. Focusing on 2  (two) points of problem formulation, first, how is the analysis of progressive legal  theory on legal protection for minors victims of bullying according to the Positive  Criminal Law and Islamic Criminal Law? Second, what is the analysis of the theory  of the purpose of punishment towards legal protection for minors victims of  bullying according to the Positive Penal Law and Islamic Penal Law?  The type of research used is qualitative research with juridical-normative research  methods that are descriptive-analytic with an analytical approach model adopted  from the study of normative legal research methods. The primary data sources used  came from Law Number 11 of 2012 concerning the Juvenile Criminal Justice  System, Law Number 35 of 2014 concerning Child Protection, Progressive Law  Book by Satjipto Rahardjo, Book of Principles of Criminal Law by Amir Ilyas, and  al-Fiqh al-Jinayah Book by Marsaid.  The results obtained are based on the research conducted. First, that the current law  in positive criminal law is still not in accordance with the will of progressive law  which says that law is for man and not man for law. Both positive criminal law and  Islamic penal law are not in accordance with what is required in progressive law.  Second, in the theory of the purpose of punishment, which is about restoration,  which says that the goal is done to restore the condition of the victim as before, but  in reality it is still focused on punishment for the perpetrator only.
