The opposition becomes problematic actions since the ‘haram’ fatwa upheld by many Islamic organizations is politically supported by the government laws. In addition, this prohibition, both religiously and legally, is in accordance with anti-smoking campaign which, in fact, goes globally. The idea of the dissertation came up seeing the fact that the ‘haram’ fatwa is confronted with the local custom and the community sociology of the inhabitants who have been highly familiar with cigarette industries for decades. The questions coming up are as follow: Why do Muslim clerics and many Islamic organizations in Kudus tend to oppose the fatwa on banning of cigarette-smoking? What resistance forms and Muslim cleric stand points are there in the so-called ‘town of kretek’? What have been done to introduce and amplify alternative fatwa? In this qualitative research any social institution involving in the process of fatwa production is described as a solid structure of social construction. The study specifically discusses several Muslim clerics from Islamic organizations; Nahdlatul Ulama (NU), Muhammadiyah, Majeli Ulama Indonesia (MUI), and Salafi are among others. Their involvement during observation stage is essential in the identification and understanding the on-going social process. The study discovers three major points. First, the strong dominance of haram fatwa against cigarette by many Islamic organizations and the national and international political pressure were two fundamental reasons for Muslim clerics of Kudus to stay in opposition considering the huge number of the town dwellers’ dependence upon cigarette industries. Besides, these religiously knowledgeable people, who own a symbolic capital, managed to back the opposition. Second, the counterattack against the ‘haram’ fatwa was expressed by not passing it on to the congregations regardless the organization the ulama is in (MUI, Muhammadiyah, or even Salafi). Third, there was a tendency to maintain current fatwa on cigarettesmoking, i.e. makruh or mubah. This fatwa, in fact, was favored by many social elements and ulama full of symbolic capital, wealthy entrepreneurs, and cigarette-industry supporting political policy. When maintaining the fatwa, these Muslim clerics were not practically under the economic power control, but they played an important role as they risked their symbolic capital and managed to persuade other capitals, i.e. economic institutions and politics, to alter theirs.
