"For Muslims, marriage should follow both Islamic law and\r\nstate law. Some of them, however, take Islamic law but leave the state\r\nlaw behind. While kyai holds the authority of Islamic law and assures\r\nthat all religious marriage requirements are in existence, penghulu – a\r\nreligion ministry representative to witness and record a marriage – has\r\nthe one of the state’s matters. When a couple finds it impossible to\r\nregister their marriage with the state law – represented by local\r\nReligion Affairs Office (KUA), they go to religious law for solution\r\ndespite the potential legal problems in the future because of the\r\nabsence of the certificate.\r\nThis study aims to elucidate the followings: first, what types\r\nof unregistered marriage are there in Pekoren society? Second, to what\r\nextent is the shift of role and motif from unregistered-marriage doers\r\nin Pekoren society? Third, why does Pekoren society move away from\r\nregistering their marriage? To explicate this unusual practice, a law\r\nauthority theory of Khaled Abu el-Fadel, which distinguishes the\r\nauthority in being from the authority on being to describe the authority\r\nof kyai and penghulu, was employed. Social action theory of Max\r\nWeber and voluntary theory of Talcott Parson were also used to\r\ndescribe the role of actors involved in such marriage. Applying sociolegal\r\napproach, this research focused on marriage law and took cases\r\nof unregistered marriage practiced by Pekoren people. Data were\r\ncollected through interviews with a number of informants, direct onsite\r\nobservation and documentation.\r\nThe study drew some points. First, there are three types of\r\nunregistered marriage practiced by Pekoren people: underage couples,\r\nelderly widow-widower couples, and out-of-Rembang couples. Under\r\nthe religious values they believe and the rational considerations, the\r\nKyai serves as the akid during the wedding ceremony. Second, the\r\npeople, who involved in the ceremony, are the bride, the groom, the\r\ncustodian, the witnesses, and the matchmaker. Upon the couple’s\r\nrequest and theological motif, kyai serving as the akid is meant to be\r\nspared the adulterous sin. The matchmaker is responsible for the brideto-\r\nbe availability, the wedding ceremony arrangement, and the kyai or ustadz readiness. The negotiation between the groom-to-be and the\r\nmatchmaker determines whether or not the process should go on.\r\nThree, there are three underlying reasons behind the shift of\r\nPekorenians’ perception of registering marriage. First, the local\r\ngovernment’s unregistered-marriage prohibition and its punishment.\r\nSecond, the society’s better awareness on registration. They perceive\r\nmarriage registration to be positive, and prefer KUA penghulu to kyai.\r\nThird, the weakening role of kyai in the religious law on-being\r\nauthority. The role of kyai in this respect has increasingly been\r\nreplaced by KUA penghulu because of the possible negative impacts\r\nof unregistered marriage.
