The uncertainty regarding the position of the AD/ART of political parties has raised new discussions in the legal world, such as the status of the AD/ART and the decision-making process if there is a discrepancy with the AD/ART, while the Supreme Court itself rejected the review of the AD/ART which should be the authority to test the Law against the Law. Therefore, it is very important to analyze how the AD/ART of political parties functions as a derivative of law that regulates the structure, organization, and governance of political parties in accordance with the provisions of applicable laws. Because the AD/ART is an attributive regulation that obtains direct authority from the Law on Political Parties which is a state institution so that the consequence is that the AD/ART is a statutory regulation. In this study, the author uses a normative legal research method by examining statutory regulations, legal literature, and related documents that help answer the problem regarding the position of the AD/ART of political parties as attributive regulations. This study uses qualitative research and the nature of the research in this thesis is descriptive analytical with a statute approach by collecting legal teaching materials and then compiling and analyzing the reading sources. The results of the study indicate that the AD/ART of political parties function as attributive regulations that regulate the implementation of legal provisions that are more general than laws. The position of the AD/ART as an attributive regulation has important implications for the internal governance of political parties, as well as the rights and obligations of members. The consequences of implementing AD/ART that are not in accordance with the law can result in internal conflict and legal uncertainty. This study provides insight into how the internal mechanisms of political parties can be controlled to ensure compliance with higher legal provisions. %Z Pembimbing: Udiyo Basuki, S.H., M.Hum.
