abstract: Online transportation is a transportation service that uses application technology that people often use easily, just using a smartphone to make ordering and making payments easier. Many online motorcycle taxi drivers experience potential accidents. Therefore, there is a need for insurance protection to ensure the safety and welfare of drivers. However, working as an online motorcycle taxi driver has very high risks. It is very important to have insurance protection for online motorcycle taxi drivers. There needs to be an evaluation of the implementation of online motorcycle taxi companies' responsibilities in providing accident insurance for drivers who work at online motorcycle taxi partner companies.
In this research, the researcher uses a normative type of research. Normative research is intended as a type of research whose findings are obtained through legislation and a conceptual approach. The legal sources used in this research come from primary law such as Law Number 40 of 2014 concerning Insurance, Law Number 22 of 2009 concerning Road Traffic and Transportation, and several oher regulations relating to cases raised by the authors of the thesis.
The research results show that: (1) Online motorcycle taxi companies are obliged to provide insurance protection to their partners, namely online motorcycle taxi drivers, in accordance with the provisions stipulated in statutory regulations. (2) The company may be subject to sanctions if it is proven to have violated its obligations in providing insurance protection to online motorcycle taxi drivers. And there needs to be increased supervision in law enforcement against online motorcycle taxi companies to give workers the right to guarantee insurance protection in accordance with existing regulations.
